Interpretation and Definitions
Interpretation
Words with capitalised initial letters have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural form.
Definitions
- Company refers to Experience Orkney, 12 Faraclett, Kirkwall KW15 1XD, United Kingdom.
- Service refers to the Website and tour services provided by the Company.

- You, meaning the individual or legal entity booking or participating in a tour.
- Private Tour means a tour booked exclusively for You or Your group.
- Group Tour means a scheduled tour shared with other participants.
Acknowledgement
These Terms and Conditions govern Your use of the Service and participation in tours operated by the Company.
By accessing the Website or booking a tour, you agree to be bound by these Terms.
You confirm that You are over 18 years of age. The Company does not permit bookings by individuals under 18 without adult supervision.
Your use of the Service is also subject to our Privacy Policy.
Payment Terms
- Full payment is required at the time of booking to secure your tour.
- Accepted payment methods include cash, bank transfer, PayPal, and debit or credit card.
Private Tours
- Full payment must be made at least 7 days before the tour, unless otherwise agreed in writing.
Group Tours
- Full payment is required at the time of booking.
Cancellation Policy
Private Tours
- Cancel up to 14 days before the tour for a full refund.
- Cancel within 14 days, and the full payment is non-refundable.
Group Tours
- Cancel up to 7 days before the tour for a full refund.
- Cancel within 7 days, and a 50% refund is available.
- Cancel within 48 hours, and no refund will be provided.
Cruise Ship Cancellations
Experience Orkney is not liable if a cruise ship cannot dock due to weather or operational reasons. We strongly recommend purchasing appropriate travel insurance.
Tour Changes and Itinerary
We aim to visit all locations listed in your itinerary. However, site availability, weather conditions, or closures may require substitutions of equal value.
- Private Tours:
Requests for changes must be made as early as possible. If changes cannot be accommodated, the standard cancellation policy applies.
- Group Tours:
Changes to group tour itineraries are not permitted.
Behaviour Policy
Inappropriate, threatening, or disruptive behaviour will not be tolerated.
The Company reserves the right to terminate a tour immediately, without refund, if a participant engages in:
- Threatening or inappropriate behaviour toward staff or others
- Causing a nuisance in vehicles or at tour sites
- Malicious damage or theft at historical or cultural sites
Incidents involving damage or theft will be reported to the relevant authorities.
Liability
Many tour sites involve uneven terrain and natural surfaces.
Participation is entirely at Your own risk.
To the maximum extent permitted by law, Experience Orkney is not liable for injury, loss, or damage sustained during a tour, except were caused by proven negligence of the Company.
Links to Third-Party Websites
Our Service may contain links to third-party websites. We have no control over their content or practices and accept no responsibility for them.
Termination
We may suspend or terminate access to the Service or tours immediately, without notice, if these Terms are breached.
Limitation of Liability
To the maximum extent permitted by law, the Company’s total liability shall not exceed the amount paid for the tour or 100 USD, whichever is lower.
The Company shall not be liable for indirect, incidental, or consequential damages.
“AS IS” Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, except where legally required.
GDPR and Data Protection
We securely store personal information in accordance with GDPR requirements.
Any printed materials containing personal data are destroyed after tour completion.
Governing Law
These Terms are governed by the laws of the United Kingdom, excluding conflict-of-law rules.
Dispute Resolution
If a dispute arises, you agree to first attempt resolution by contacting the Company directly.
And Waiver
If any provision is deemed unenforceable, the remaining provisions remain in full force.
Failure to enforce any right does not constitute a waiver of that right.
Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated were reasonably possible.
Continued use of the Service constitutes acceptance of the revised Terms.
